The words we ask people to agree to
Two moments, and the exact words for each: when a business saves a card with us, and when someone calls a business that uses Recepción. They are here so that nobody has to take our word for what was said.
Saving a card
This is the statement next to the box a business ticks when it saves a card. Ticking it is the agreement, and we keep the record of when it happened. It is written the way Stripe, which handles the card, asks it to be: who may charge, how much, how often, and how to stop.
I authorize Borinken Labs to save this card and to charge it «its monthly price», plus any IVU that applies, every month for «the plan you chose», without asking me again each time. The first charge is on «the date of the first charge»; after that, on the same day every month. If I change plan, the charge changes to that plan's price and I am told before it happens. I can cancel at any time from my account or by writing to hola@borinkenlabs.com; the service runs to the end of the month I have already paid for, as the refund and cancellation policy says.
«The plan you chose», «its monthly price» and «the date of the first charge» are filled in with your own plan when you see it on the sign-up screen.
Answering a call
This is what a caller hears before anything is recorded, in the caller’s language. Nothing is recorded until the caller agrees.
This is «business name»'s assistant. The call is recorded and transcribed, and «business name» may text you at this number. Is that okay?
Yes is the caller’s own word — “yes”, “sure”, “okay”, “sí”, “claro” — or pressing 1. If the assistant did not catch the answer, it asks once more:
Sorry, I didn't catch that. If that's okay, press 1.
If the caller says no, says nothing, or is not understood, this is the whole call. The business is told only that the number called, and when:
Understood, nothing is recorded. «business name» will see that you called and will call you back. Thank you for calling.
After a yes, the assistant invites the message, and gives one more way out:
After the tone, say your name, your address and what you need. When you finish, press pound or hang up. If you do not want your message recorded, press nine.
Why it is asked this way
Puerto Rico’s Penal Code (Ley 146-2012, Article 169) makes it a crime to record a private conversation without the express consent of everyone on it. A notice on a wall does not cover a phone call, and staying on the line is not a spoken yes. So the assistant asks, and it waits.
What the question covers, and what it does not. It covers two things and names them both: recording and transcribing the call, and the business writing to you at that number. It says “text”, and text is what we mean — a message to your phone. It does not cover WhatsApp, Instagram or Messenger, and Recepción does not use them. It is not consent to a promotion either; a promotion needs permission you gave the business separately, in writing.
A business using Recepción can adjust the wording of its greeting, but the question is always asked, and it cannot be switched off. When our copy of these words and the product’s differ, the product’s is the one a caller heard.
